Please read these Terms of Use carefully before using the Application (defined below). These terms and conditions regulate the use of the Application provided by PriceRunner Ltd. ("Pricerunner"). By using this Application, you signify your assent to these terms and conditions and agree to be bound by them. If you do not accept the terms and conditions as described below and do not agree to be bound by them, you should immediately stop using this Application. PriceRunner reserves the right, in its sole discretion, to modify, alter or otherwise update these terms and conditions at any time and, by your continued use of the Application, you agree to be bound by such modifications, alterations or updates.

Costs
The Application is provided to you free of subscription charges and has no one-off payment charge. However, you will be charged by your mobile operator for data costs that are accrued when you download the Application and use live access to the PriceRunner data as requested. PriceRunner shall have no responsibility for transmission of funds due to any third party with whom you may elect to deal. You shall be responsible for transmitting all payments due on the terms agreed with any third party.
Restrictions
You agree not to reverse engineer, disassemble, decompile, reverse translate or in any way decode the Application or any copy or part of it in order to derive any source code or other underlying materials or information except insofar as permitted to do so by law.
User Information
You acknowledge that PriceRunner collects personal information about you and how you use the Application (the "Collected Information"). You agree that the Collected Information may be used by PriceRunner and its affiliates locally, nationally, and internationally in an unencrypted form.
Your phone number is used within the Application for the 'Request Callback' feature. When using this feature you will be asked whether you agree for the phone number to be passed to the chosen retailer to receive a phone call from such retailer. You will be given the choice to approve or reject this action before any data is sent. Your phone number will not be used for any unsolicited calls or actions outside the scope of the Application by PriceRunner.
Un-register
If you wish to un-register from the Application you should text PR STOP to 60009. You can register again at any time by texting the letters PR to 60009. Remember there is no charge for the Application, except as already expressly provided for herein.

Liability
Pricerunner assumes no responsibility, and shall not be liable for, any damages to, or viruses that may affect your mobile equipment or other property on account of your access to, use of, or browsing in the Application or your downloading of any materials, data, text, images from the Application. In no event shall PriceRunner or any 3rd party be liable for any injury, loss, claim, damage, or any special exemplary, punitive, indirect, incidental or consequential damages of any kind (including without limitations loss of profits, business interruptions, or loss, corruption or misdelivery of data), whether based in contract, tort (including negligence), strict liability, or otherwise, which arises out of or is in any way connected with (i) any use of the Application or content found herein, (ii) any failure or delay (including, but not limited to the use of or inability to use any component of this Application for subsequent purchases or decisions) or (iii) the performance or non-performance by PriceRunner or any 3rd parties, even if such a party has been advised of the possibility of damages to such parties or any other party. In its sole discretion, in addition to any other rights or remedies available to PriceRunner and without any liability whatsoever, PriceRunner at any time and without notice may terminate or restrict your access to any component of the Application. Your use of the Application are at your risk. Neither PriceRunner nor any other party involved in creating, producing, or delivering the Application is liable for any direct, incidental, consequential, indirect or punitive damages arising out of your access to, or use of, the Application. (Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties.) PriceRunner cannot be held responsible for any technical malfunctions or disruptions to the services on offer on the Application.
Indemnity
The material that you read on the Application is provided solely for information purposes. Neither PriceRunner nor its affiliates or its content providers are responsible or liable to any person or entity whatsoever (including, without limitation, persons who may use or rely on such data/materials or to whom such data/materials may be furnished) for any loss, damage (whether actual, consequentially, punitive or otherwise), injury, claim, liability or other cause of any kind or character whatsoever based upon or resulting from any information or opinions provided in the Application. You agree to indemnify, defend and hold PriceRunner and its affiliates, and their respective directors, owners, agents, information providers and licensors harmless from and against any and all claims, liability, losses, costs and expenses (including reasonable legal fees) incurred by any indemnified party in connection with any breach by you of these terms and conditions. PriceRunner reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and in such case, you agree to co-operate with PriceRunner's defense of such claim.
Applicable Law
This agreement shall be governed by and construed in accordance with the laws of England and Wales and both parties hereby submit to the exclusive jurisdiction of the courts of England and Wales. Any action you, any 3rd party or PriceRunner bring to enforce this agreement or, in connection with, any matters related to this Application shall be brought only in the courts of England and you expressly consent to the jurisdiction of said courts. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
